Federal Court Orders Freedom of Kilmar Abrego Garcia from ICE Detention
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks lawful basis.
"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.
The situation stems from a mistaken deportation to El Salvador in March, which the government later admitted was an error. Following his return to the United States to answer human smuggling allegations, he was held in federal custody.
In her order, the court noted that the government does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
